The western educational jurisprudence has gradually changed its nature from obligation-oriented to the right-oriented property since the 1950s of the 20th Century, and has brought qualitative changes to the nature and intension of the right of being educated. The concept of the right of being educated, which brings impact to old theories of learning and teaching, is of great significance to the establishment of the study-typed society in the intellectual economical epoch, the transformation of the present concept of educational legal system and to the amelioration of the educational system.The concept of the right of study has further developed to become an upper concept which covers the right to be educated. It emphasizes that the right of study, born in the nature, is a initiative natural human right to choose education and to complete and develop our personality and personal character. Also it is a social right because the country and society have the obligation to provide necessary condition and help to guarantee the right of study of every individual.Besides, as a human right that every individual should have, the right of study still needs to be completed in the legislation. The right of study hasn't been fully legislatively guaranteed because of the stagnation of the guiding principle of the Constitution and the laws of our country although some clauses of the Constitution of our country have the regulations of personality development and the freedom of Learn.
