The rapid development of biotechnology provides a vast development space for agriculture, forestry, animal husbandry, medicine and the food industry. But it also gives rise to ethical, physical health, environmental protection and many other problems. In our country the biosafety law could hardly match the biotechnology. Public are ill-informed on biosafety law and the omission, the narrow, law enforcement, inadequate oversight bodies of the law make our biosafety legislation lags far behind the development of biotechnology. And the development of biotechnology can follow nothing. Thus, the sound of our biosafety legislation in the current is necessary and urgent.This article discusses the legislative issues on the security of transgenic technology and its products. Through understanding " The Protocol on Biosafety " -- the mainstay of international biosafety legislation, it studies on the different patterns of biosafety legislation in the United States, Canada, European Union, Australia, Japan and other developed countries around the world. We can take advantages from them and look for a suitable pattern or a new way to set up the biosafety legislation system to fit the development of biotechnology in our country.Through the autocriticism of our legislation and the lucubrating of the advanced legislation of the developed country, this article rise the precautionary principle, control principle, intervention principle, in principle, and responsibility principle as the basic principles of our biosafety legislation. Then improve our biosafety legislation system under the guidance of these principles. First, enacting a "biosafety law" as a framework for the laws of the biosafety management; Second, making special laws on the biosafety management, or supplying with the existing laws which are in connected with biosafety problems; Third, making laws on genetically modified organisms environmental impact and safety assessment, cross-border transfer of the management of biotechnology, genetically modified organisms labelling management, and other areas of laws and regulations to face biosafety problems recently; then, giving some suitable advices on the main issues of biotechnology that damage the legislation and the disputes of procedures legislative; Last, pointing out other...
