After the emergence of the social division of labor force the conflict between Trade and Environmental Protection appears progressively in the process of producing and exchanging commodity. Only at past, the environmental problem was always considered to be a problem of local area. However, accompany with the development of the social productive force, the environmental problem has already became a prominent problem from a potential and backstage crisis, which cannot be neglected by the human being along with the strengthen of the international trade activity and the depravation of the environment and the resource after entering 20th century, especially in the 90's. Now it becomes an important social topic to investigate the relationship and to looks for a harmony way of development between the trade and the environment.As a local area organization, the model EU has been always walking on the front row of the world in the aspect of the harmonious development between the trade and the environment. In 1972, the European Economic Community convened the head of the statement and the government of his member's country to hold a summit conference, which formally uncovered the prologue of the large-scale environmental protection. Through the operation of several decades, today the EU has already groped for a set of relatively effective methods to moderate the relationship between trade and environment.Firstly, the EU has the sound policy and sturdy law system as the strong backup force in the fields of trade and environment. The EU trade and environmental policy and law system are mainly constituted by two parts: the EU environmental system connected with trade and the EU trade system connected with environment. The EU environmental system connected with trade follows the system of the law of the European Union in frame. In this system, the constitutional norm, namely the Primary Community Law, which found the European Economic Community or the European Union, plays a very important, essential and guided function.
