On The Criminal Summary Procedure

The existing criminal summary procedure of China was formally determined in the criminal law, 1996. Then, it was amended. The Supreme People's Court, the Supreme People's Procurator ate and the Ministry of Judiciary drafted so called Streamlined Common Proceeding. However, our criminal summary procedure has not been a systematic frame; moreover, the existing criminal summary procedure is lack of lightness and economics. With the further development of modern society, some drawbacks have been emerging among the criminal summary procedure. This thesis introduces the criminal summary procedure and analyzes the lightness and economics of it. Then it inspects and analyzes the criminal summary procedure abroad. Finally, it raises assumption for reconstructing domestic criminal summary procedure and establishes a suit of scientific and rational criminal summary procedure system.Part I of the thesis includes introduction and Chart 1. It draws forth the issue of criminal summary procedure by striking the balance between justice and efficiency. It introduces the implication, development survey and tendency of respective foreign countries.Part II of the thesis includes Chart 2 and Chart 3. It discusses the lightness and economics of the criminal summary procedure. On the aspect of lightness, it expounds the criminal summary procedure is in line with proper procedure demand; on the aspect of economics, it analyzes the economics of criminal summary procedure from the angle of justice efficiency and economics.
