Summary procedure is in pursuit of solving the problem of efficiency under the background of justice. But in China today, judicial operation of the summary procedure cannot reach the core of legislation, and it produced a lot of problem. In practice, some local law courts are trying to simplify the general procedure. As it did not prepare enough in theory and practice, it is not surprising that it brought about some contradictions and resulted in some embarrassment. So it is quite necessary to research in comparing the criminal summary procedure of different countries all over the world, especially, several powerful countries such as Britain, America, France, Germany, Italy and Japan. The author compares and analyses the forms and features of summary procedure in foreign countries and the thesis deals with the essential nature of summery procedure firstly. Consequently, the writer explores into Chinese model of summary procedure including its defects and its due difference which China has experienced, aiming at providing advice for research, legislation and jurisdiction field.
