Research On The Protection Legal System Of China's Foreign Direct Investment And Its Maturity

Our country has got fast development in Foreign Direct Investment after the eighties of last century. It has already become the important part of foreign economic interaction of our country. But our country's legal protection of the foreign direct investment is not in the good conformity with it. I regard legal protection of China's foreign direct investment as the idea of the thesis selected title in this inspiration.Because of the special circumstances and legal status of the foreign direct investment, they face more commercial risks and non-commercial risks. That the commercial risks belong to the range that the foreign direct investor oneself can control, but control of non-commercial risk is not in their power. Compared with the domestic investment project, they need protection of the country further. Our country roughly has two ways to the protection of the foreign direct investment at present: First, participate in and sign the multilateral international treaty; Second, conclude the bilateral investment Treaty. These two ways are both international legal system aspects. The multilateral international treaty related to the investment protection that our country participates in being signed at present has TRIMS, GATS, TRIPS under WTO legal frame and MIGA conventions.
