The Analysis Of Legal Status Of Public Colleges In China And Its Legal Relationships With Students

To improve the legal consciousness of teachers and students, strengthen the construction of educational legal system, establish a harmonious relationship of colleges and students and improve the lawful management of colleges, it is of great importance to make clear the legal status of public colleges in China and its legal relationships with students. The writer believe that the legal status of public colleges in China should be multiple, it possesses not only legal status of civil status, but also legal status of administrative status when deal with affairs involved in the students' right to be educated, so, the implementation of its functions could be checked up by administrative lawsuit. Therefore, there are civil lawful relationship and educational administrative lawful relationship between colleges and students in China. From the view point of main body, the colleges possess lawful functions of education, administration and protection to students, at the same time, students possess corresponding legal rights and assume corresponding legal obligation.
