A Study On The Protection Of Students' Rights Under Rhe Administration By Law In Colleges And Universities

The concept of"building a harmonious socialist society"was put forward in the sixth Plenary Session of the sixteenth CPC Central Committee. According to this session, a harmonious society is a society embodying democracy and legality, fairness and justice, honesty and friendship, vigor and security, maintenance of social order and concord between the nature and man. Colleges and universities, as an important part of the ideological and cultural sphere of CPC, play a significant role in building a harmonious society.Starting from some relevant theories of harmonious society, this study reviews the historical process of the administration of law in colleges and universities. Based on the specific cases in which students'rights are encroached on under the administration by law in current colleges and universities, this study analyzes why colleges and universities do not pay much attention to students'rights, and in line with the requirements for building a harmonious campus, it comes up with some solutions to the problem.This study mainly consists of the following sections:In the first section, this study, based on the relevant theories of harmonious society, gives a description of the meaning and characteristics of harmonious campus, the significance of building a harmonious campus as well as the role that rule of law plays in the administration of a harmonious campus.In the second section, this study reviews the history about the protection of students'rights in colleges and universities, and points out that the phenomena of"weak law"exist in their administration. In addition, based on the current law and regulation, it analyzes and states the fundamental rights that college and university students should enjoy, and discusses some specific cases in which colleges and universities encroach on students'rights.In the third section, this study analyzes why colleges and universities do not pay much attention to students'rights, and comes up with some solutions in the hope of promoting the building of harmonious campus.
