The Research Of The Countermeasures Of Preventing And Controlling Of Attacking Police Crime In China

Because of the special role of the police, the crime of attacking police, which seems to be infringing the individual police, has actually seriously damaged the authority of the state's law. Once the authority is provoked publicly, the state law will face the danger of being unenforceable. On the other hand, this situation may also cause the public uncontrollable fear of crime and illegal activities, it may even make the civilians lose confidence in the legal order. As the protector of the people, if his or her own security can not be ensured, how could he or she protect the people? In this case, the whole society will lose control and get into a mess. Further more, it may increase the unhealthy tendency of using violence against the enforcement of law, hinder the police from fulfilling their duty of punishing crime and illegal activities, and of maintaining the social security; it may also frustrate the morale of the police, and may have negative effect on the social security. It is that the phenomenon of attacking police took place in high frequency makes the society pay great attention to the phenomenon and makes the public fell alert to the fact that this kind of crime has not only infringed the police's rights but also has severely provoked the authority of the state police. The academic circle has not started the discussion of the phenomenon of attacking police until recent years, most of the achievements can be found in some newspaper and many pieces of thesis in some periodicals. As a police who have been working for 15 years, the author pays special attention to the crime of attacking police. After collected and sorted out many recent year's materials concerning this crime, aiming at various types of attacking police crime, from the aspect of crimin ology, firstly the author made some analysis about the phenomenon and characters of the attacking police crime, which led to the conclusion that the crime of attacking police has the following features : it has special victims, violently and often accompanied by other kinds of crimes ,it also causes sever damages; secondly, the author discussed the causes and relative facets of the attacking police crime from three aspects like victims, criminals and society; finally, on the basis of comparing and researching the countermeasures, both at home and abroad ,of preventing and controlling the crime of attacking police , the author proposed some reasonable measures. The main preventing countermeasures are: enhance the consciousness of self protecting, improve the skill of preventing and combating violence, reduce the possibility of being attacked, speed up the construction of the police in communities, maintain close ties between the police and the residents, reinforce the protecting measures of social security, accelerate the development of the public security industry, legitimize the assisting police status of the security personnel, relieve the pressure of the police, pay more attention to the police-public relation construction, promote the police images, improve the law enforcement circumstances, perfect the relief system to the police being attacked, Take strong measures against the crime of attacking police and against those crimes aroused by it etc. Meanwhile, in view of the importance of legislation that could prevent and control crimes, hereby, the author discusses whether it is necessary to add the crime of attacking police in criminal law. In the end, the author analyzed several basic problems of preventing and controlling of the crime of attacking police, so as to make things easier when taking proper measures.
