Since the reform and opening up,the public security organs have paid a high price of "one person dies every day and three thousand people are injured every year" for the sake of national stability and social tranquility.However,with the rapid development of social economy,police attacking cases occur frequently,and the style of attacking police is constantly upgrading.The increasingly serious phenomenon of attacking police has brought greater challenges to police law enforcement.Attacking the police has become a hot issue in the public mind.It is imperative to regulate the criminal law of attacking the police.This article mainly discusses the following aspects:Chapter one enumerates the cases of attacking police in China in recent years,explains the current high incidence of this phenomenon and analyzes the necessity of criminal law enforcement from three aspects,and discusses different views of the academic circles on the concept of crimes of attacking police behavior.This paper identifies the concept of attacking police of establishing a crime.The second chapter analyses the current criminal law regulation mode and the specific problems in judicial practice in China,and illustrates the specific disputes in the form of cases,such as the degree of violence against police,the time of duty in judging the legality of duty behavior,the protection of assistant police officers as the object of obstruction of public service crime,and whether minor injuries and serious consequences belong to the standard of conviction.The third chapter aims at the above-mentioned problems in judicial practice,combs and summarizes the relevant theories and views of domestic scholars.The fourth chapter refers to the thinking of criminal law regulation of attacking police in two foreign legal systems,and enumerates relevant practical cases for analysis,to enlighten our current judicial practice.The fifth chapter puts forward the viewpoint of this article,and makes its own understanding on the degree of violence,the legitimacy of the duty behavior,whether the auxiliary police belong to the object of protection of the crime of obstructing public affairs,and whether the serious consequences belong to the standard of conviction.
