Research On The Criminal Law Regulation Of Attacking Police

The police,was the most bleeding occupational group in peacetime.In recent years,police attacked was occurred frequent in China,and the number of the events increase continuously.According to the relevant data,one policeman was sacrificed everyday in our country on average,and the number of the police who suffer physical injury during law enforcement is increasing.Since the increasing number of attacking police,all sectors of society pay extensive attention on it.“Violent attack towards police” has been defined as formal legal language in 2015 by Criminal law amendment(ninth edition),the behavior of attacking police becomes a hot topic in social and educational circles again.According to the opinions by several scholars,the main reason of increasing attacking police is defect of legal provision,attacking police crime should be established in order to against the crime.However,another part of experts have counterview,they believed it is sufficient to use the current penal code to fight attacking police crime.At present,whether and how to establish the attacking police crime becomes a hot topic by experts' argument.In conclusion,it is significant to research the attacking police behavior as the special object in judicial circle.The article has five sections except introduction and conclusion,content structure as follows:Section 1: Defining the behavior of attacking police,analyzing the characteristic,the risk for society and individual,and the reason of frequent occurrence.Section 2: The legal regulation of attacking police will be introduced and the relevant opinions in academic circles will be compared.Including the current situation of legal regulation and judicial dilemma.In addition,carding the argument of whether to establish the attacking police crime in academic circles,and the opinions by author will be presented.Section 3: This section will introduce the legislative stipulation in China and anglo-american law system,the attacking police legal regulation experience will be summarized for our country.Section 4: The feasibility of establish attacking police crime will be analyzed in the section.Summarizing the first three sections,author believed that the attacking police crime should be established,the necessity and feasibility of the crime will be discussed by analyzing the social politics factors and legislative technique factors.Section 5: In order to solve the attacking police problem in reality,the legislative ideas of attacking police crime will be presented,penalty structure and the problems in crime application will be analyzed in this section as well.
