On Legal Attribute Of Network Virtual Property Right And The Settlement Of Its Dissention

With the application and development of network technology, a lot of questions and disputes about network have come into being, especially dissentions with virtual property emerging in an endless stream, which society pays wide attentions to and becomes focus of discussion in legal circle. In theoretical circle there are many controversies about the legal attribute of virtual property . In the judicial practice the dissention with virtual property could not be settled satisfactorily because the related law is absent. This dissertation mainly discusses the nature of virtual property and the settlement of dissentions in four parts. Firstly it discusses the origin of questions of virtual property from perspective of historical development. Secondly, starting from the fundamental conception , the paper analyses the connotation of the virtual property and defines the scope of virtual property. It also defines the property attribute of network virtual property by analyzing the development trend and the characteristics of virtual property. The third part further discuses the nature of the virtual property right and its position in our law system. The end part mainly probes into the settlement of virtual property dissentions. It makes a comprehensive analysis to the possibility of litigation of virtual property disputes and what to protect the virtual property now and in future.
