Research On Legal Problem Of Students In Colleges And Universities Complaints System

In Mar, 2005, education department has published Higher Education Institution students'Management Regulation and required that each university should establish complaint dealing committee for students. In order to strengthen protection power on students'rights, in Dec, 2005, education department has published The Enforcement Advice on Legal Administration, which gave the specific requirement on implementing students'complaints system. From then on, universities have established campus complaints system, which is good way to handle the dispute between university and students and maintain students'legal rights, From Sep, 2005, after the establishment of university complaints system, students can solve the dispute and maintain rights legally and reasonably.But the legal system in China is still in a low and incomplete stage, which has existed many problems and affect its enforcement, so many scholars have begun to conduct some researches. Yet there's no systematical work on the legal problems and proper measures of complaints system. This paper is to explore and perfect the students'complaints system in colleges and universities.This paper has adopted such research methods as document reference, comparison study and case analysis, studied from the basic questions and basic law acknowledged by students, defined the words:complaint, complaint right and complaints system, clarified the theoretical foundation, feature and position of university complaints system, and analyzed the significance of colleges and universities complaints system establishment and quality of legal relation between university and students. This paper has also analyzed the problem on its legislation and practice by learning the theory and experience from foreign countries and Taiwan district and has provided the measure on perfecting Chinese colleges and universities complaints system. The aim of this study is to perfect colleges and universities complaints system, to solve dispute between university and students, to protect students'legal rights and to build legal campus management and harmonious campus.
