On the basis of people's well-being, education is the first element. Education is the most fundamental issue of people's well-being. Every one has equal rights in front of education, no matter rich or poor. It is ensured that each citizen enjoys equal rights in society and in their further development, only if every one who deserves education has the right to be educated. In 2007, China established a financial system for students in higher education, with major policies as national scholarship and grants, and locally-granted student loan. Since then, we take a great step towards the realization of educational equality. However, due to the fact that the grant-in-aid system of the higher education in China is still in it's primary stage, there are still plenty of difficulties and resistances in the operation of the system. So systematically research of the legalization of the relative systems becomes more important and urgent.This paper took into consideration of related administrative laws and systems about subsidiary policy, elaborated the legal basis of the system of financing students in national higher education,summarized the reform history of domestic grant-aided system. After referring well-developed systems of financing students in foreign countries, this paper analyzed the weak points and deficiency of current grant-aided system in China. Then this paper went on profound discussion on the legalization of grant-aided educational system in higher education, from aspects of rules and principles, procedure system, right remedy and guarantee system, and responsibility system, and further studied on its corresponding solutions. Therefore, the paper offered a theoretical support on the construction of legalization of grant-aided system in Chinese higher education.
