A Comperhensive Study On The System Of Liability Insurance Of NVOCC

With the development of international trade and transportation as well as the container industry of recent years,the non-vessel operating common carrier has risen rapidly,and it has provided a certain position in the shipping market.But we not only saw the rapid development of NVOCC,but also should notice NVOCC’s risk management of the business. NVOCC may also face enormous risks that hard to bear because of the special risks that exist in maritime cargo transportation.In order to prevent risks,in the world, there are three main forms,namely,cash security,security and liability insurance.Our government have published three ways to standard the access of NVOCC’s market.But in practice,these three systems did not effectively achieve the purposes of committing NVOCC’s risk.Our law has not have the clear definition and accountability of NVOCC,and there is still a dispute between NVOCC and International Freight Forwarder.These all kinds of problems have caused some adverse effects of the development of NVOCC.Therefore,this article proposes to build the NVOCC liability insurance system in our country.This paper is divided into four chapters.Chapter I describes the basic theory of NVOCC.Chapter II discusses the necessity and feasibility of establishing NVOCC liability insurance system in our country,and it focuses on the analysis of the current three NVOCC market access conditions, pointing out the deficiencies of them.The main content of chapter III is the construction of the system of liability insurance of NVOCC.Chapter IV suggests to build the item of NVOCC liability insurance to improve our NVOCC system.
