A Study On Ship's Secondary Registry And Related Legal Problems

Nowadays, more and more ships fly flags of convenient. In order to avoid this phenomenon, lots of developed countries, especially European countries, set up a new type of ship registry, which is called Secondary Registry and is carried with original system of the Ship Registry at the same time.Our country is a big shipping country with her shipping capacity standing on the top five of the world. But more and more ship owners choose to register their ships in the open registry convenient flag countries. This makes bad results on our country's economy and shipping system.So, how to attract Chinese ships back to register in China becomes a big problem. Here, the Secondary Registry needs to be mentioned. This thesis just brings forward legislation suggestion to set up the Secondary Registry which is suitable for our country based on the related international convention and our national law.This thesis is composed of five chapters. The chapter one mainly introduces the existing state of the Ship Registry in the world. The chapter two mainly summarizes the concept, background, and the reason of the form of the Secondary Registry. The chapter three mainly analyses the exist Secondary Registry in other foreign countries, and expatiates on the effect of the Secondary Registry. The chapter four mainly analyses the necessity and feasibility of setting up Secondary Registry in China. The chapter five mainly researches the related legal problems, built on the base of law and policy, carried in bonded port area, and brings forward suggestions on legislation.
