With the unceasing understanding of ships oil pollution and deepening senses of the international protection of marine environment and marine resources, the compensation scope for oil pollution damages from ships also expands. The resources and the environmental damages are accepted gradually by the various countries. In the admiralty practice in China, the interim and long-term fishery losses are acknowledged commonly, instead of compensation for natural resource damages from ships oil pollution. But this approach has been disputed and results in misunderstanding. How to solve the problem radically? It must make the compensation regime of National nature resource damage from oil pollution from damage in China. Then, how to found the compensation regime forms the objects of study in this paper.This paper center on the foundation of compensation regime of National nature resource damage from oil pollution from damage in China The paper consists of four chapters. Chapter One analyses the concepts of natural resource damages and the interim and long-term fishery losses from oil pollution from ships, clarifies the existing misunderstanding of the natural resource damages and the interim and long-term fishery losses and thereby establishes correct ones. Chapter Two and Chapter Three discuss the scope and assessment rules of natural resource damages from oil pollution from ships which is accepted by the international oil pollution compensation regime and U.S. OPA regime from the theory and practical aspects and make suggestion to the foundation of compensation regime of National nature resource damage from oil pollution from damage.
