Among drug-related crimes, drug trafficking is the most common one thathappens frequently. As the main force in fighting against drug trafficking crime, thepolice have made marked achievements and gained rich experiences. Meanwhile, theobstacles met during the fight have hindered further operation against drug trafficking.The thesis proceeds from the police's perspective, explores and analyzes the mosturgent problems in drug trafficking crime in four chapters.The first chapter, based on the analysis of the status quo, features of occasionaldrug trafficking and major problems met during the fight against it, puts forth the ideathat all drug traffickers should be punished according to criminal regulation and thatthe legal term on drug recommitment should be applied and that the quantity of drugssold should be added up to help the police decide the level of punishment to the drugtraffickers who sell drugs in small quantities. For the particular group in theoccasional drug traffickers, we should treat them on equal basis. At the same time, weshould adhere to the criminal law, the code of criminal procedure and relatedadministrative laws to solve the problem of arresting the particular group; for theconfirmation of the drug trafficking activity and amount of drugs sold by the criminalsin order to cover their drug-taking expenses, it should be conducted according tospecific situation.The second chapter puts forth the idea that examination of the active ingredientsof the drug is needed to determine the type of the drug so as to standardize theconfirmation of the drug captured in the drug trafficking cases. The chapter also analyzes the development of legislation on the degree of purity of drugs and relateddisputes and puts forth the idea that we should gradually expand the examination ofthe degree of purity to all the drugs and comprehensively decide the sentenceaccording to the type, degree of purity and amount of drugs. Today, the types of drugsare varied and keep increasing very fast. So, in the legislation on the prohibition ofdrugs, we should set the standards of sentences on drug-related crimes, list andpublicize them. In the following days, we should add or delete the type of drugs oradjust the converting standard according to the changing situation of drug traffickingand the requirement of the fight against it.The third chapter mainly analyzes the practical application of the investigationwith police entrapment in drug trafficking cases as well as the various opinions of it incriminal law theory field. The chapter puts forth that legislation should be made toendow the unit working on the suppression of drug trafficking with the power to carryout the investigation with police entrapment, strictly control its applicable conditionand manage the nark according to law.The fourth chapter analyzes four difficulties: the debate whether profit-seeking isan essential element to confirm a drug trafficking case, how to determine thedeliberate intention of the drug trafficker, how to distinguish the crime of drugtrafficking from the one of illegally possessing drugs, and how to distinguish the actof helping the drug-addict to buy drugs as a go-between from the act of buying drugson behalf of others. The four points play key roles to determine the nature and type ofthe crimes. Based on the analysis, I have put forth my own opinion in the thesis.
