The collective land ownership as an ownership unique in China originate from China, and causes many disputes in academic circle. Analysis of Causes of the Flaws of Collective Land Ownership and Its Development Mode, while - illustrating the concept of collective ownership and its present state, analyses the flaws of this form of ownership and the causes. The writer goes on to propose some possible ways out. This article includes 5 chapters, sequentially being Introduction, the Concept of Collective Ownership, the Birth of Collective Ownership and Its Present State, the Causes of the Flaws of Collective Ownership, Possible Solutions.In chapter one of introduction, the paper approaches the necessity to research the problem on the fact of disputes in the academic circle on collective land ownership; then depicts the research situation in China (since it is a special form of ownership, it's researched mainly by Chinese scholars); at last describes the basic methodology to provide feasible way on the basis of research results.In chapter two of definition of collective land ownership, the paper firstly analyzed the definition of ownership, holding the opinion that a way of combining concrete listing and abstractionism to define collective land ownership. That is to say, collective land ownership can be defined as the ultimate right to occupy, to use, to benefit and to dispose collective landholders hold to the land in the legal scope. There is no definition of collective land ownership in traditional civil law, the collective land ownership of our country is a product of law to meet the requirement of economic basis, is a creation of China, a definition with Chinese character. There is no way to give a clear definition of collective land ownership.In chapter three of the origin and present situation of collective land ownership, the writer discussed the process of the development of collective land ownership. Based on its development, the tide of agriculture collaboration in 1955 and the advanced cooperative movement in 1956 produced directly collective land ownership. The nation cancelled the farmer land right of private ownership with political movements and non-economic measures, and established collective land ownership system in our country. The purpose is to develop industry in advance; requiring peasants to provide capital needed the industrialization of our country.
