On Public Security Intervention On Family Violence

Family violence is a social issue commonly existing in the world, and its assaulter and sufferers involve every estate and realm of the society, no matter what their origins, races, occupations, sexes, ages, religious belief, education background and economic status are. It was in 2001 that China explicitly proposed the first time in MARRIAGE LAW the concept of FAMILY VIOLENCE. And in the same year, the concept of FAMILY VIOLENCE was defined in Supreme People's Court Notice Regarding the Application of Marriage Law of People's Republic of China. Public security organs, as the state apparatus to defend the state security, maintain social public order, protect citizens' personal safety, personal freedom and legal property, protect public property, and take precautions against, determent and penalize illegal practice, have unshirkable responsibilities towards intervention on family violence. However, since China doesn't have consolidated anti-family violence law, certain related laws and gist could only be found loose in existing Criminal Law, Civil Law, Criminal Procedure Law, Public Order Administration Punishment Law and etc., moreover the public security organs have certain limitations within its inner system, and the masses are impercipient on the illegality of family violence, there are still a lot of issues when the public security organs conduct the intervention on family violence, which has greatly influenced the intensity of eliminating family violence. In order to eliminate family violence to the largest extent, and better protect the legal rights of the citizens, China could use foreign protective order and police service system for reference, and draw up ANTI-FAMILY VIOLENCE LAW based on our own situation to perfect the inner system of the public security organs, improve police's enforcement quality, intensify jural propaganda, and set up the social mutual protection mechanism, which would definitely promote the united action of the society and build a harmonious society together.
