A Study On The Interference Of Public Security Organs In Domestic Violence

Domestic violence not only seriously harms the body and spirit of the victims,but also destroys the equal,harmonious and civilized family relations,and affects the harmony and stability of society.For many years,social organizations of state organs,including public security organs,have been exploring various methods and measures for the education of legal administration to prevent and punish domestic violence.In particular,the Law of the people's Republic of China on domestic violence,which was implemented in 2016,not only shows the state's attitude towards prohibiting any form of domestic violence,but also provides a direct and specific legal basis for public security organs to intervene in domestic violence.However,from the promulgation of the Law of the people's Republic of China against domestic violence,there are still many difficulties in the intervention of domestic violence by public security organs,and the effect is not satisfactory.Domestic violence and malignant domestic violence continue to occur.In view of this situation,first of all,according to the existing research,this paper re combs the concept,characteristics,guiding ideology,principles,authority and significance of public security organs' intervention in domestic violence,and clarifies the logical starting point and basic principles of the research.Secondly,this paper makes an in-depth analysis from four aspects.The first is about legal issue such as the ambiguity,imperfection and impracticability of the current law.The second is about problems of public security organs.For example,the public security police do not have a good understanding of the nature and harm of domestic violence,their enforcement is inadequate.At the same time,we are short of professional departments and performance appraisal system against domestic violence.The third is about problems in the ideology,behavior and capacity of victims and related masses.The third problem is that,the linkage mechanism of state departments and social organizations has not yet been established and perfected,and the existing and facing problems of public security organs' interference in domestic violence.Through this research,we can better put forward targeted countermeasures.Thirdly,this paper studies the experience of police intervention in domestic violence in the United States,Britain,Canada and other countries.We try to find and summarize the experience that can be used by Chinese public security organs.Finally,in view of the existing difficulties,this paper argues that we should strengthen the legal literacy,improve the intervention skills,strengthen the team building,establish a prewarning mechanism,refine the intervention mechanism in the event,establish a follow-upmechanism after the event,enrich the rescue system,explore the linkage mode,use the warning system,use appropriate related charges to propose and build an operational countermeasures,which are helpful to improve the work of public security organs in intervening domestic violence.
