Environment problem already becomes the grave social problem, it arouses the attention of the whole world. Every country adopts administrative, economic, technological and legal means to protect the environment, including the Criminal Law means. The environment problem is the social problem appearing in marching toward ecological culture course. Because of the times limitation, traditional Criminal Law and its theory can not adapt to the need of ecological culture successfully. The article put ecological culture idea into effect. It adopt historical method and comparative method. It discusses the fundamental theory of Environment Criminal Law with central clue of legal interest. Thought comparing environment criminal legislation thinking and the legal interest of environment criminal law with Germany, Japan, Taiwan, then we come to the concept of the legal interest of environment criminal law in ecological culture times different from traditional environment crime and their theory. We think that environmental right is the ultimate aim and the maximal criterion of environment criminal legislation. It to tables some proposals of the environment criminal legislation and judiciary in our country.
