Reconstructing The Criminal Law Protection System Of The Ecological Environment

Ecological environment is one of the prerequisites for our survival and development.In today 's society,With the rapid growth of production capacity and rapid economic development,increasingly prominent and serious environmental pollution,has severely restricted the sustainable development of human society,and became a we have to face seriously and solve social problems.The current situation of environmental pollution and environmental damage in China is very serious,and further deterioration will endanger social stability and survival of the people,there is an urgent need for criminal law to respond effectively.However,there are still many deficiencies,in the current criminal law failed to good play the role of environmental protection.New forms of environmental damage behavior with the rapid development of social and economic appear constantly,our country criminal law in dealing with the environmental damage behavior regulation means the co-action.This article embarks from the practice,combining with the author's working practice,to propose some legislative and judicial reform proposals,in order to improve our ecological environment protection criminal system,to achieve comprehensive environmental protection,to achieve sustainable economic and social development of our country's objective.This paper is divided into three parts,the first part discusses the current status of legal protection of ecological environment in our country,and cause harm.The second part compares the situation of environmental criminal law protection in some representative countries in order to get reference.And the third part is to analyze the existing cases in the field,and to analyze the cause of the problem,and then to suggest some personal insights into the protection system of the environmental criminal defense system in our country.
