Research Into Legal System Of Supervision On Use Of Insurance Funds

With the increasing use of insurance funds, we can find the use of funds of insurance companies in our country is still subject to the related laws and regulations, which has great effect on solvency of insurance companies and the potential risks. Therefore how to use insurance funds has become a vital problem in the development of Chinese insurance industry. There are great quantities of materials for reference on multiplying ways of using insurance funds and on effective use of funds, but there is few in the aspect of legal supervision. Accordingly, in this article, the author, by discussing how to perfect legal system of supervision on use of insurance funds, makes a systematic research into legal system of supervision on use of insurance funds to preserve and increase the value of insurance funds.The first chapter gives us an introduction about the significance of the use of insurance funds, and about the analysis of some basic legal problems such as its supervision to show value and effectiveness of law, and because of the characteristics of insurance industry. The use of insurance funds in foreign countries has been developed for a time, so their regulations on legal system of supervision on use of insurance funds are of great significance for reference to our country, and in the second chapter, by adopting studying methods of comparison and examples, introduces us the supervision system in main countries of two legal systems, such as England's, America's and Germany's, and provides us with some experience. The chapter three tells the development course of the use of insurance funds of China, gives us a summary on existing problems on legal systems of the use of insurance funds in the current insurance system, which mainly appears as the government's too strict supervision on ways of funds use, lacking strict liability system, out-of-date and unsystematic regulations, and etc. In order to solve these problems, in the forth chapter it is discussed how to perfect legal system of supervision on use of insurance funds in China according to China's actual situation both from external and internal aspects.
