The Juristic Study Of Textile Specific Safeguard Measure

This thesis is about the juristic study on the Chinese textile specific safeguard measure under the WTO's frame .On one hand the author wants to clarify the application of the China textile specific safeguard clauses, on the other hand to interpret the challenge which our country textile industry faces and the corresponding countermeasure which is adopted through the introduction of the cases of the textile trade conflicts between China and the Occident.There are four parts in this thesis. The first part is about "The specific safeguard measure under the WTO's frame", which is the general introduction of the specific safeguard measure. This part includes: (1) the general introduction of the safeguard measure (2) the general introduction of the specific safeguard measure (3) the differences between the safeguard measure and the specific safeguard measure .The second part is about "the Chinese textile specific safeguard clause interpretation", which is the legal analysis of the Chinese textile specific safeguard clause. This part includes: (1) the backgrounds and the reasons that Chinese government accepts the specific safeguard measure (2) interpreting the principles which the Chinese textile specific safeguard provision observes (3) applying the principles above to interpret < Protocol On The Accession of People's Republic of China > and < Report of The Working Party on The Accession of China > .The third part is to analyze the compromises of our country textile trade by introducing the example of "the trade dispute between China and the Occident". The part includes: (1) the reason that why the Occident take the measure to China (2) the harm that the trade dispute brings. The fourth part is to propose the corresponding countermeasure that our country should adopt aiming at "the trade dispute between China and the Occident". This part involves: (1) strengthening to optimize our country domestic textile industrial structure (2) mastering the method of applying the Chinese textile specific safeguard clause correctly (3) reducing the influences on the specific safeguard measure by using the WTO's rule (4) consummating the legislation on our country textile industry.This thesis is only the author's some superficial understanding. And the author hopes that the thesis can provide the reference to solve the safeguard measure that foreign countries will take. This effect is also the author's wish.
