A Study On The Countermeasure Of Special Safeguard Measure For China Under WTO System

After China's accession to the WTO, Trade Protectionism, which is extensively adopted by some western countries, has been a big problem of our international trade industry. Because of the relative lower price and higher quality, Chinese products have been often attacked by Trade Protectionism in the international market. Safeguard Measure, along with anti-dumping and countervailing, has become another trade remedy we are faced with.Special Safeguard Measure in the WTO system is a kind of special transitional safeguard measure for specific products. There are provisions of Special Safeguard Measure that is specific to particular products in WTO legal documents, Such as Agreement on Agriculture, Agreement on Textiles and Clothing, General Agreement on Trade in Services, if it is in emergency. When China applied to join in the WTO in 2001, for fear that the increase amount of imported products from China will leave negative impact on its domestic market and the domestic industry, many WTO parties added provisions about Special Safeguard Measures in negotiations of China's accession to WTO and stipulates in Item 16 of Protocol on China's accession to WTO and Report of the Working Group on China's accession to WTO.Therefore, it is conducive to the development of China's foreign trade protection of the legitimate interests of export enterprises to Study on the reasons why our external trade industry suffers from Special Safeguard Measure frequently and study on Strategies we can take to against it.This paper introduces the basic theory of Special Safeguard Measures, analyzes the meaning, nature, history respectively. Second, it discusses the special legal regulation about Special Safeguard Measures in WTO system and other WTO members'Special Safeguard Measures that is specifically target to China. Then, the dissertation analyzes our country's legislation and the drawbacks in it. Through deeply analyze on three typical cases of special protection, we will elaborates on the reasons why China is vulnerable to Safeguard investigation and the negative impact of China's foreign trade coming from special protection measures.Based on the analysis of basic theory and practical experience of Special Safeguard Measures, this paper puts forward specific strategy for China's coping with Special Safeguard Measures.
