Public participation is the core of the assessment system of environmental impact. The environmental impact assessment system couldn't come to be true without public participation. Environmental impact assessment system in China seems not to be mature. Some obvious facts can prove this point. "The storm of environmental impact assessment"and"the accident of summer palace" have revealed the drawbacks of the environmental impact assessment system deeply. The main reason of the above problem can be attached to the scarcity of public participation system. So I try to take "the Public Participation in the Assessment System of Environmental Impact in China" as the title from the view of comparative environment administrative law. I believe that it must be useful to our country by learning the developed country's experiences.This paper mainly includes five parts. The first section points out the importmant of public participation in the environmental impact assessment system, and gave the method to solve it. Then in the second, third and fourth sections the paper analyses the situation of the USA, Japan and Germany. Based on the above discussions, we can know about the whole structure of the proper environmental impact assessment system in the world. In the end, the writer discusses the hypotheses of improving the public participation system in the environmental impact in a systematic way from the integrated perspective of substantive law and procedural law, with the present situation of environmental law and practicalsituation in China taken into account. The hypotheses include: endowing precisely citizens with the right to protect environment in a legal sense (establishing the environmental right in an substantive sense and a procedural sense), working out administrational procedural law, information publicization law, identifying the legal status of the environmental protection NGO, and implementing environmental litigant system for public interests, etc.
