Research On Legal Issues About Public Participation In Environmental Impact Assessment System

China's national economy has made significant achievements since opening reform, but the accompanied environmental pollution is becoming more and more serious. Faced with the deteriorating environment and the imperfect environmental protection system, the root of issues is the environmental impact assessment system didn't play the right role .Environmental impact assessment system is an environmental legal system, which intended to prevent and reduce the bad impacts which the development acts caused. Public participation is the key elements in the environmental impact assessment mechanism operating, it could make the public aware that the significant and potential environmental problems which existed in the development behavior, it also could make the development behavior more reasonable and acceptable.This paper study on the public participation in environmental impact assessment system for perfecting . First of all, the essay defined some concepts about the public participation in environmental impact assessment system from the theory foundation, and introduced the development of this system home and abroad. Public participation in environmental impact assessment system is founded in our country later, there are some laps between developed countries with our country, but we also have yielded some results. Environmental Protection Administration public the Public Participation in Environmental Impact Assessment Interim Act in February 22, 2006 as the first legal documents which operated in environmental protection ,which be put into effect from March 18 the same year. This Act will put important impact on promoting and building the public participation in environmental impact assessment system. Secondly, analyze the status quo of the public participation in environmental impact assessment from the reality, we can see more issues existed during the system be put to practice. These problems include: the form of public participation is single; environmental information which not covered be public passive; public opinion couldn't be done with well; relief measures put the ineffective act on public participation in environmental impact assessment; poor awareness about the public participation in environmental impact assessment. Finally, in order to make up the inadequacy of this system, the article introduce the approaches to improve the public partition in environmental impact assessment system from the establishment of environmental information public system,partition mechanisms and environmental public interest litigation system three aspects: provide good conditions for public participation in environmental impact assessment through the foundation of the environmental information passive public; analyze the subject and the measures belonged to the environmental impact assessment to improve the public participatory mechanisms in the system; reflect on our country's public interest litigation system, to promote the public participation in environmental impact evaluation system under the protection of the law. Through those approaches we can got the final goal which to perfect the public participation in environmental impact assessment system.
