Research On The Rural Social Assistance System In Our Country

This dissertation is on the study of the rural social assistance system. The purpose of this research is to inspect the operative effectiveness and the institutional perfection concerning the rural social assistance system in our country and to bring about the legislative improvement in our country according to the idea of economic law. It will widen the theoretical achievements in the research of economic law and provide some theoretical support for the legislation of the rural social assistance system in our country. The dissertation mainly consists of three parts.Section one is about the summarization of the rural social assistance system, including the definition, the basic ideas and the value of the rural social assistance. Firstly, the author holds that the rural social assistance is a modern and meaningful concept and it is a kind of social security institution that state and society adopt in various forms, such as taking material assistance or supporting the production and so on to protect their basic livelihood in the rural areas for those people unable to work, or to obtain in other source of income and those elderly, disabled, or ill persons. The aim of this system is to help them overcome the poverty. According to the cause to the poverty, the rural social assistance system consists of poverty-related social assistance, disaster-related social assistance and disease-oriented social assistance. Secondly, the author considers that the rural social assistance system includes the basic ideas of subsistence, development and harmony of society and its value mainly embodies the fairness value and the safety value. The rural social assistance system responsing to the survival rights'request is to response to the call of the fairness values; meanwhile it conforms the force of the rural poor and dispel their sufferings and resistances, exerting its function for the sake of safety value.Section two is concerned with the reflection of the rural social assistance system in our country, including the appraisals, the deficiencies of the rural social assistance in our country and the necessity for enhancing the rural social assistance system. Firstly, the author introduces the appraisal of the rural social assistance system in our country. For example, the accurate orientation, the assistance mode of lowest life, the characteristic institution, the definite right conception and so on. It has played a great pole in our society. Secondly, there are some problems, such as the lack of law concerning the rural society assistance system, the narrow scope of the rural social assistance system, people's reluctance to attach importance to the rural social assistance system both in theory and practice and so on. Finally, the paper dwells on the necessity for enhancing the rural social assistance system, and it can be divided into three parts. Part one talks about protecting the basic living rights of the rural poor. Part two is about the promotion of the society, maintenance of stability. Part three is to perfect the development of the society and economy in the rural.Section three is about the improvement of the rural social assistance system in our country. After the research, we consider that although the rural social assistance system in our country has experienced some reforms in recent years, there are still many deficiencies. We should accelerate the establishment of market economy in the rural society to adapt to the new legal aid system at the top of our agenda. In this part, the author tries to put forward some suggestions about the subject, the target and rescue standards, the institutions of raising and distribution assistance funds and the legal liability of the participator. Part one considers the subject of the rural social assistance should be clear, and we should pay attention to and support community participation in to raise the social level of social assistance, besides the main subjects of the government. Part two considers that the target and rescue standards set in the rural social assistance should includes four vulnerable social groups and the criteria of social relief for the rural poor should be the focus. Part three considers that the institutions of raising assistance funds should persist in the principle of giving priority to national budget, supplemented by the financial expenditure levels, promoting the donor community, and establishing the rural social relief. At the same time, the procedure of the distribution of the relief should be clarified. The procedure institutions applying for assistance should design the application institution, the means-tested institution and the supervised institution dynamically. Part four considers that the legal liability of the governors, the supply organizations and the assisted persons should be clear.Generally speaking, the rural social assistance system is an important part of the social security system and plays a great pole for the development of the society and economy. It is closely related with the rural labor's personal benefit, and has high theoretical and social value. As the completion of the theoretical research and laws and regulations, the rural social assistance system in our country will better play its role and better sever our society.
