Research On The Victim's Judicial Assistance System

Criminal victim assistance system is a guarantee system of the victim's dignity.In the development of our country's criminal victim assistance system,there have been many actual problems,such as there is no legislation at the national level,which results in disunity in local operations;Rescue object is not clear,which leads to the property crime and the company crime victims' right not well protected.Rescue way is less,the current compensation for money only made of local regulations,and it is not enough to effectively compensate for the victim's spiritual damage.Rescue program is not fine,director of relief funds in the judicial practice subject assumed not fair,and the rescue conclusion is difficult to satisfy the victim.At the same time,the existing regulations are less of supervision for the assistance subject,which is not conducive to the maintenance of judicial authority,on the other hand,because the cardinal number of people who meet the national conditions is too large,and the level of economic development between regions are different,as the "fight fires" system,it is difficult to make a unified legislation from the national level,otherwise there will lead to a state which a case cannot matter,the official can finish but the people cannot finish,social relations are more difficult to repair,thus it will violate the original intention of the system design.This essay is under the guidance of the existing "Opinions on the Establishment and Improvement of the National Judicial Assistance System",some supplementary opinions are made,such as introducing the victim community staff in the evaluation process to strengthen persuasion of the assistance decision.It should consider increasing the application of the victim after the failure of the complaint channels;strengthening the supervision mechanism for the payment of assistance agencies,allowing the system to operate under the sun,to exert supervision effect of the people and so on.
