Research On The Constructions Of The Rule Of Law From The Aspect Of The Socialist Harmonious Society

From the aspect of the socialist harmonious society, taking the Marxist theory as the guideline, basing on the relationship between the socialist harmonious society and the socialist rule of law, applying the researching method of positive and normative integration, this thesis analyze reasons for anti-harmonious society, and deeply explore paths of the rule of law to realize the socialist harmonious society. According to the present definitions of the socialist harmonious society, I think the concept of it should be defined like this: be basing on the rule of law; people being the subject; embodying fully the essence of Chinese socialism; and being developing state of system. Basing on the historical development and the degree of realization, I think, the harmonious society is including pre-modern harmonious society﹑modern harmonious society and communist society. The purpose of the harmonious society is to realize the communist society. After defining the rule of law and the rule of socialist law, I analyze the inter relationship, between the socialist harmonious society and the socialist rule of law, namely that they are not only have common theory bases which are the socialist democracy and legal system theory and present view of socialist scientific development, but have common psychical support which are person-based﹑fairness﹑ justice﹑order and so on. The socialist rule of law supports the socialist harmonious society. Consequently, I point out the main problems in the present social life. To illustrate, income gap has being enlarged; public power harms private rights; corruption and other decay cultural life exit. I think reasons for those problems are the following: the in-mature market economy and rule of law interact;"power"and"legal"are not totally dissolved; and the culture of the rule of law is not fully formed. Roads of dissolving these problems are the rule of law. Strengthen the idea of the rule of law﹑the construction of legal systems and implementation of law. In our daily life, we should adopt the concrete ways. In economy, enhance the economic rule of law and matured the socialist economic market system; in politics, strengthen the Communist Party of China﹑government and civic involvement under the rule of law; at last, pay attention to the culture of the constructions of the rule of law, legalize some ethic and strengthen people's legal belief.
