Improving The Exit & Entry Legal System With The Administrative Law

The entry & exit administration is a kind of legal system which the international society extensively implement, and through which all countries manifest their national sovereignty, and safeguard the national security and benefit. The current administration on exit and entry in China is the exercise of jurisdiction, through which, the country administer the entry & exit of Chinese citizens and aliens and related matters , the entry & exit authorities regulate and control the activities of entry &exit, and also is one part of the national jurisdiction with the foreigners, and it is very important to safeguard its state sovereignty, security and interests, protect the legitimate rights and interests of Chinese and other countries' citizens and promote the exchanges in the political, economic and cultural between China and the other countries.At the beginning of the founding of new China , our country had formulated laws on the entry and exit. Since more than 50 years, along with the development and the change of the national politics, the economical situation, as well as with the needs of friendly exchanges, our entry and exit law and the policy also have experienced a developmental process, the central authorities have successively formulated a series of entry and exit laws and regulations, and gradually instituted the established the administrative system with the Chinese characteristic on entry and exit by the establishment of the local authorities.Alone with the social development, something incompatible of the exit and entry administrative system have emerged. For example, the defect of the immigration laws and regulations and the limitations of the system place restrictions on that the system bring the advantage in opening outside the world into play. 2008 Beijing Olympic Games approaching, the growth of the exit and entry people needs more security in the ports. China's existing exit & entry administrative system can not meet the 2008 Beijing Olympic safety requirements. Mainly in the following three aspects : First, simplify the administration to Chinese citizens in the passport application and issuance , the account, the type of travel documents and other types of dual citizenship; Second, strengthen the control to the foreigners, which involves the management of foreigners, the foreigners who are not allowed to entry, and illegal entry of the punishment; make the content and jurisdiction of the frontier inspection clear, especially the transfer of border problems. To ensure the safety of 2008 Beijing Olympic Games, further to safeguard social stability and promote China's economic development, the author proposes that improve the legal system,administrative enforcement and supervision of law enforcement to conduct the legal system to be more suitable for the 2008 Beijing Olympics Games by reviewing the history of our entry and exit legal system, researching the present situation.
