Since last century, how to definite subsidies and countervailing measures reasonably had become an urgent affair. After being first mentioned in Havana Charter and taking its shape in GATT, subsidies and countervailing measures had been refined in Tokyo Round, but all above were not the accurate ones, it was in Uruguay Round that the definition of subsidies and countervailing measures was accurately defined. Yet since the rapid development of international trade and the aggravation of trade competition, insufficiencies have turned out in the definition, such as the definition of subsidy bodies, the identification of ways of public support, benefits and specificity standards are all of vital importance in the definition of subsidies and countervailing measures. However, because of the deficiency of the regulations, it is just on the above aspects that will probably cause a set of problems. So how to definite it better under the existing system in order to develop it scientifically and further get use of those two measures more reasonably has become one of the most important events for us.After entering WTO, China is speeding up rapidly to join the big international economy tide. How to follow, make use of, develop, make reference and draw lessons from the existing international rules so as to strengthen legal development of subsidies and countervailing measures of our country, protect domestic industries while taking part in the international trade cooperation has become a practical problem for us.The dissertation focuses on the legal problems of subsidies and countervailing measures in the international trade realm. It primarily discusses the unclear and ambiguous substantive principles in the subsidies and countervailing measures so as to interact soundly under the guidance of correct theories and the spirits of "fairness" and "freedom" in the international trade, and reach an overall balance favorable to the healthy and stable development of the global economy and society. Meanwhile, the dissertation also put forward some possible suggestions and opinions based on the realistic and our own legal condition. Last but not least important, as the writer of this essay, I hope the subsidies and countervailing measures law and its practice will become more and more perfect.
