The Law Of Subsidies And Countervailing Measures Of WTO And The Steps Of Improving Chinese Legislation

This dissertation focuses on the legal system of subsidies and countervailing measures of WTO.It elaborates the basic theories and important legal problems of subsidies and countervailing measures of WTO systematically,and cites several Western Countries' domestic laws and practices to proof the relative theories.The aim is to solve the problems of countervailing measures in Chinese legislation and practices.This dissertation is composed of three parts:preface,text and conclusion.There are four chapters in the text.Preface mainly talks about the background of selected subject,the significance of study,the method of research and the characteristic of the paper.Chapter One is concerned about the overview and evolution of subsidies and countervailing measures.It first views the definition and characteristic of subsidies and countervailing measures to disclose the inner reason of emergence,and then introduces the evolution progress of some important international and domestic rules in this area, i.e.,the WTO rules,the Weston Countries countervailing laws.Chapter Two expounds on the legal practices of the Western Countries on subsidies and countervailing measures.This chapter analyzes four key issues about international trade nowadays-the specificity standard,the benefit standard,the legal problems in injury of subsidies and the causality between subsidies and injury.Chapter Three analyzes the relative provisions on subsidies and countervailing measures of WTO.It contains three parts:the first part discusses the legal system of WTO on the four problems above and the special and differential treatment for developing countries;the second part comments the rules of subsidies and countervailing measures of WTO;the third part explains the differences between SCM and the Weston Countries' domestic laws with the comparative method.Chapter Four discusses the method of establishing the legal system of countervailing measures in China.It starts with the review of current situation of Chinese countervailing measures,and then analyzes the gaps in Chinese legislation and SCM and the Weston Countries' domestic laws.It finally discusses the method of improvement in Chinese countervailing measures and raises several feasible suggestions.Finally,this dissertation summarizes the theme of subsidies and countervailing measures of WTO and several Western Countries' practices,and concludes Chinese countervailing measures and practices with new trend in subsidies and countervailing problems.
