The Study On Legal Matter In CEPA's Implementation Process

CEPA is the English abbreviation of "Mainland and Hong Kong Closer Economic Partnership Arrangement". From its first implementation until now, it has made positive advancement function for promoting the Mainland and the Hong Kong Special Administrative Region economy development. But we have also discovered there are some legal problems which have to be solved. This has left pondering space for our theory studies.As the CEPA's concept, background and law basis are the basis, this article conclude the character of the CEPA, what is an arrangement of area economy integration between the Mainland and Hong Kong.Through the introduction of the implementary conditon of CEPA, conclued that there are still some detail problems have to be complemented. The problems are: what the boundary of "serving provider" in CEPA, who has the right to explain the CEPA and how to solve the contention. For the first problem, through the comparison of regulation between GATS, CEPA and domestic law, suggest how to solve the contention. For the second problem, firstly make sure the character and principle of the contention between Mainland and Hong Kong, secondly introduce some dispute settlement bodies which can be used for our reference, at last, suggest that we can solve the contention by combining consulting and arbitrating.
