Research On Legal Problems Of CEPA

The "Closer Economic Partnership Arrangement"(CEPA) between Mainland China and Hong Kong,Macao is a typical pattern of regional Wade arrangement,which fully developed China's advantage of"One country,four seats" in WTOIt is a domestic regional legal arrangement regarding the convennience of goods trading,service trading and trade investment which utilize WTO exceptional regulations of free trade agreements signed by both of the parties.Meanwhile,CEPA should deal with the issue on the balance of rights and obligations of WTO members under WTO rules,with no precedent.The subscription of CEPA has a great significance on the improvement of WTO system and the construction of the economic and trade legal systems of China,and Four Seats".he subscription and impact of CEYA is of great significance for the improvement of WTO system and development of China's "One country,Two systems" principals theoretically and practically,especially the Content of the confirmation of"Zero Tarii',"Rules of Origin for Trade in Goods" and the definition of "Service Supplier" aresignificant for the construction of legal system in market economy of China.CEPA opens a door of national service market of to the service suppliers of Hong Kong and Macao.In particular,the opening of 18 service industries has far exceeded the promises that China made at the WTO entry and supplies the treatment of "earlier thanFast Alliance and better than the promises of WTO entry" to the services suppliers of Hong Kong and Macao,which creates benefits for mutual prosperities of China mainland and Hong Kong and Macao.The thesis introduces the contents of two legal texts and its annex mainly,combines the WTO regulations,the promises of Chinas WTO entry and the existing laws of Mainland China,Hong Kong and Macao to deeply excavate CEPA's legal objective and finds its origin of legal effect.The thesis also introduces its development primary content, objective,legal principles,discusses the legal significance of CEPA and exposes its existing persuing objective and finally supplies the solutions.
