On The Protection Of Human Rights For The Social Vulnerable Groups Of China

Since the reform and opening-up, the problem of social vulnerable groups has been becoming evident because of the constructive adjustment of social lamination resulted from the development of market economy. The law is the social regulator and the regulator of the social'interest connection. Whatever it was be concerned in the important social interests, it is not avoid in the law. Therefore, it will bring the problems of social vulnerable groups into the view of law, which is the bounden liability of the law.This text divides three parts that are foreword, text and conclusion. Among them the text has been explained from four respects.The first part defines the vulnerable groups at first, then put forward the point about the meaning of vulnerable groups according to comprehensive resources possession amount of average. Considering the background of Chinese social transformation, the part divides the Chinese vulnerable groups and generalizes the fundamental characters of the vulnerable groups.The second part analyses special causes of the social vulnerable groups and points that their generation is connected with economic development and classes differentiation in the period of the social transformation. It is the inevitable outcome of social transformation and the inevitable price in the definite meaning. From the three aspects including economy, politics and rule by law, the part analyses that the existence of the vulnerable groups restricts sustainable development of Chinese economic, affect social stability and hinder the process of rule by law. At last, it defines the necessity of protecting the vulnerable groups from three aspects including socialistic essence, the requirements of sustainable development and the pursuit of values about justice in the harmonious society.The three part demonstrates the jurisprudence on protecting the vulnerable groups from the human rights aspect. At first, it reveals the central value of human rights and fundamental character and demonstrates that protecting the vulnerable groups is necessary to protecting dignity. Secondly, it describes the developmental process and tendency of human rights, and points that protecting the vulnerable groups is the developmental direction of human rights from three generations points of human rights. At last, it generalizes the doctrine of protecting the vulnerable groups on international human rights law and points that equality doctrine and leaning protection doctrine are fundamental doctrine in the international human rights law. Through generalizing the concrete institutions on protecting the vulnerable groups in the international human rights law, it provides the background for the fourth part.The fourth part analyses the shortcomings on social secure rights, be educated rights, labor rights of protecting the vulnerable groups in China and put forwards the points about protecting the vulnerable groups from three aspects including improving material of protection rights, economy society culture rights, participating the politics rights.
