Research On International Law Problem Of Human Rights Protection Of The Vulnerable Groups

Nowadays, the problem of the human rights of the vulnerable groups is a hot problem that is generally concerned by all the countries under the background of globalization. However, "vulnerable groups" has not become an agreeable concept in international law until now. In this paper, the author analyses the definition of vulnerable groups and outlines the origin of vulnerable groups. On the basis of learning from definitions of vulnerable groups which are defined by Sociology, Economic, Logic and other subjects, the author figures that vulnerable groups is an institutional concept which establishes on the basis of value judgment in the eyeshot of law.As enjoyable rights of human being, the core value of human rights is that it maintains basic dignity as human being. As the adjustable tool of social relationship, law must take on the mission of protecting human rights and maintaining the vulnerable groups' rights. By analyzing the value of law, the author points out that general human rights, legal rights, substantive equality, maintenance of order and harmonious society are the legal bases of human rights protection of the vulnerable groups.U.N. is not only an origin of legalization of international human rights protection, but also a core organization that makes international regime of human rights protection complete gradually. This paper gives full details of international convention and documents about human rights which are constituted and passed by U.N. and its specialized organizations, major area international organizations. Most of them are pact and protocol which are about protecting pocketed individual and groups so that they reform special field of vulnerable groups' protection in the international human law. Meanwhile, it also becomes extensive and multiform protective measures and supervision system of vulnerable groups' human rights.Finally, though constitution and execution of above-mentioned documents improve situation of vulnerable groups' human rights, survival situation of vulnerable groups is still very serious in the range of international society. Right now, we are engaged in building a harmonious socialist society. How to establish an effective legal system of protecting the vulnerable groups is imperativeness in front of us. This paper deeply analyzes shortages of international legislation and problems in execution and considers rationally and proposes direct suggestions according to perfection of law system of human rights protection of the vulnerable groups in our country.
