India is a multi-religious and multi-cultural country . Hindus, Muslims,Christians ,Buddhists,Sikhs and Jains live together in this country. Religious life is an important part of Hindu daily life,religion plays a great role in India . In such a country how to guarantte every person′s religious freedom, how to realize equal freedom of every classes of religion, what the scope of religious freedom of denomination should be granted, how to deal with relation of all the religions and denominations and let them get along with each other harmoniously, all these problems are the ones India had to resolve. In history , India is a country of religious tolerance, but two times of conquest by foreign country brought other religions which became strong competitors of Hinduism .meanwhile brought religious contradiction . Pakistan splitting from India is the result of religious contradiction taken advantage of by politics . So India needs to regulate the right to freedom of religion in the basic law to solve the complicated religious problems .The independence of India in 1947 and later the birth of the Constitution of India timely fit this condition. The Constitution of India 1950 regulated the right to freedom of religion in detail in the part of fundamental right , mainly focused on social reform and public policy ,which built a solid foundation for the realization of religious freedom .The word"secular"is formally written into the preamble to the Constitution according to the 42th amendment of the Constitution of 1976 ,from then on the secular character of India had been set up ,Which further made clear that the Country should treat all the religions equally and neutrally .In the long time of judicial practice ,the courts of India explain and perfect the legal provisions of religious freedom by judicial judgements ,Which makes the Constitutional articles more applicable.The rationality of Constitutional provisions of the right to freedom of religion should be admitted undoubtfully after more than half a century . To a certain extent these provisions guaranteed realizing the religious freedom of all the religious people and religious groups ,meanwhile promoted religious harmony .But the power of law is not enough in order to solve the problems of religious conflicts and religious discrimination completely. we also need political, social , cultural and other factors develop with law accordingly , meanwhile religion itself should timely reform to fit its members′needs .so in order to realize the content of the right to freedom of religion turely, India has a long way to go.
