Study On The Socialization Of Execution Punishment

Taking a comprehensive view of the mankind's penalty history, the execution of punishment has tended to become light, and punishment of imprisonment has been the core of system of punishment in the place of capital punishment and body punishment. Jail had been regarded as the best place to reform convicts and finally make them rehabilitate .But the limited of the jail resources, cost of high and crime rate of high become huge anti- bad and make people's conviction agitatedly. People start to think about the rehabilitation of jail. But punishment of imprisonment always adopts the methods of separating convicts from the rest of the society to achieve its end of rehabilitation, and that makes the paradox between its means and end。Imprisonment not only disfranchise but also deprive of the convict's rights to catch up with the society .Thus, convict will become abnormal person in normally social outside. To solve the above paradox, the socialization of execution punishment is put forward. This paper has defined the meaning of the socialization of execution punishment from the theories, and through comparison of the socialization of execution outside and inside combining our country's realistic circumstance; discuss our country's socialization of execution punishment preliminarily. I hope that this paper will be helpful to develop the theory of the socialization of execution punishment.This paper consists three chapters.Chapter one has summed up the brief history of the socialization of execution punishment and defined the concept of the socialization of execution punishment, and discusses the value of studying the socialization of execution punishment.Chapter two is the comparison of the socialization of execution outside and inside. In this section I mainly discuss the related legislations and practice in America,English,Russia,Japan,Hong Kong,Macao and our country's realistic circumstance.Chapter three has proposed to better the community punishment system in China and offered some suggestions of reforming and bettering application and execution systems.Finally, I put forward some suggestions to reform the system of execution of punishment and introduce the system of correction.
