A Study On China's Community Correction System

Community correction is the result of system of punishment in the world. It demonstrates the rule is becoming much more civilise, humanitarianism and smoothly. As used widely in the world, it is necessary to take the experience of abroad to perfect our rule according to the antinomy of society. But as a new born, it still has a long and tortuous road to travel. In order to expansion our anti-imprisonment, we certainly make the community correction becoming possibility and used widely in China.As an important reform of judicial system, community correction officially introduces by 2003, and piloted in six cities and country such as Beijing, Shanghai, Zhejiang,ect. at the same time. Presently, community correction is becoming ascendancy and gets an exciting result, it embodies the most important from city community.This report deal with the study of community correction, from simply introduce the basic , analysis's the necessity and feasibility ,join together with the pilot result especially in Beijing and Shanghai, base on its application , principle, structure , method of work , get a conclusion of community correction. Of course, in the past several years, it popular neither on theory nor practice. But our pilot still in an indistinct way, how to further on community correct and prefer is we need to think , take the progress as experience and review the difficult meet during pilot is a good way to develop in future. This paper expands the theory and practice of community correct, upon the progress which already get from pilot, analysis four problems in operation, which are the old concept about application on system of punishment; impeded progress of legislation which lack of law ; in-strength of setting which leads to low specialization; lack of social security which could not enable to fulfill community correction. Also it suggests how to perfect our community correction: the first is to exchange the traditional views on system of punishment; second is to make relevant legal system to perfect; third is to reinforce institution construction and improve the quality of staff; fourth is to make an innovation system of community correction.
