Therefore, a very important factor to measure a nation's degree of civilization is to what extent women's rights have been protected. Of all these women's rights, the most important right is women's labor rights in that labor is not only a means to make a living, but also is closely related to the way an individual fulfills himself and the way individual dignity is respected. In China, the legal protection of women's rights have been implemented in the existing laws, policies and regulations. To be more specific, the articles of China's 1954 Constitution and some other relevant laws such as Labor Law and Women's Rights Law have clearly defined the terms to ensure the realization of women's rights. However, with the development of socialist market economy and the reform of political system, some law prescriptions can not keep up with the times and thus the equality of men and women in their labor rights can not be realized, as a result of which, women' labor rights are frequently violated. Therefore, it is highly necessary that we should take some measures to cope with thesituation.In this dissertation, the author, basing her arguments on the analysis of the existing laws and regulations, illustrated the significance of women's labor rights from macroscopical and microscopical angles and pointed out the possible obstacles which hinder the realization of women's equality with men .In the end, she also put forward a legal protection and relief system based on Chinese unique circumstances thus hoping to provide feasible solutions to women' issues from a legal perspective.The dissertation consists of four parts. In the first part, the author illustrated the significance of women's labor rights. Women play a very indispensable role in our revolutionary cause and economic construction as well. They contribute a great deal to the building of socialist material basis and promote the harmonious development of the society. In the second part, the author analyzed the possible obstacles which hinder the realization of women's equality with men from macroscopical and microscopical angles and pointed out that the realization of women's rights is determined by social, historical and legal factors and the problem itself. In this legalized society, deficiency of the system is the key to all theproblems. In the third part, the author proposed how to perfect this system--by drawing upEmployment Rights Law and perfecting branch laws, in view of legislation systems adopted in western countries. In the fourth part, she also put forward a legal protection and relief system based on Chinese unique circumstances thus hoping to build an effective mechanism to help enforce law and guarantee the smooth running of lawsuit proceedings .
