The Regulation Of Standard Terms In Telecommunicatication Contracts

Standard terms are from abroad. With the development of capitalism , standard terms have been widely used in developed countries. So the customers have to accept these unfair terms in trade. Telecommunication service contract is generally signed by the means of standard terms. Its attributes such as compelling force, broad objects, the unbalance of party's economic position easily damages the benefit of customer. The rights balance problem between telecom operators and customers is presented exactly in standard terms of telecommunication contracts. Therefore, Only reasonable telecommunication contracts may maintain fair of contracts and protect rights of broad telecommunication customer. In this situation, that how to regular standard terms, specially, standard terms of telecommunication contracts, by the means of law to maintain social fair and healthy and order development is a new issue. Sum up, this paper presents some suggestions and solutions to this issue by analysis of telecommunication contracts of China and combination of foreign regulation experiences and methods.
