Study On Legal Issue Of Land Requisition Of Our Country

At present, our country practises the public ownership of land, that is to say, land is owned by the state and collectivity and individual citizen has no ownership of land. Farmers only have the rights of use and contract management of the collectively-owned land. Farmers, especially the fanners excluded from the Social Security System, will not get timely, fair and reasonable compensation and settlement once their land is requisitioned, which results in their serious life condition. The present legal system of land requisition was formed in the highly centralized planned economic structure in 1950's, which ever played a great role in the government administration and national development. With the development of the economy and society, especially in the course of socialist market economic system establishment and urbanization, the legal system of land requisition has caused many social problems, such as unclear demarcation of public interest, improper government roles, abuse of land requisition right, low compensation standard and single compensation means. Therefore, it has practical meanings to study and develop the legal system of land requisition and compensation.The thesis is composed by seven chapters: Introduction (Chapter One), Summary of land requisition and compensation (Chapter Two), Principle of land requisition and compensation (Chapter Three), Calculable standard of land requisition and compensation (Chapter Four), Means of land requisition and compensation (Chapter Five), Process of land requisition and compensation (Chapter Six), and Conclusion (Chapter Seven). It attempts to find some suitable law theories and systems to improve the system of land requisition and compensation through the study of foreign land requisition and compensation system and on the basis of our own situation.
