Legal Supervision Of Chinese Telecommunications Industry

With Competition being brought into telecommunication industry, the monopoly of this industry will no longer exist, therefore, it is critical to establish modern supervision and management system on this industry. However, affected by various factors and limits, unlike the shock therapy, it is difficult and impossible for the country to establish such a system in a short time. Instead it will be a long and gradual process. During the process, sometimes, it is even unavoidable for this industry to suffer from setbacks. Therefore, we are required to take relating theoretical and realistic issues into account when we establish the telecommunication supervision system. Having studied the history of the development of telecommunication industry of other countries, we knew that most of them exert effective supervision on this naturally monopolized industry by the virtue of law. Thus, It is easy to make the conclusion that we should also get started to study the law supervision and management on our telecommunication industry on the basis of our country's particular circumstances. On one hand, we should make a comparative study on the reforms of other countries, learn from their experience, and understand the different supervision system and their executive system. On the other hand, we should also explore the uniqueness of our country's telecommunication supervision system so that we should make and improve our law on the supervision system, on the execution and on the inspection system of supervising right. As a consequence, it is of both theoretical and realistic significance to study on the legislation and supervision system of the telecommunication system.This thesis guided by the related planning documents concerning"The Eleventh Five Years plan", by learning the advanced supervision system from foreign countries, adopting theoretical, comparative and generalized analysis and basing on the realities of the industry, focuses on verifying and demonstrating the supervision system of telecommunication industry and puts forward some suggestions on the innovation and improvement of this system. The thesis is composed of four chapters. The first chapter, through exploration of the past and present situation of the system, introduces the definition of telecommunication supervision system and points out the necessity to execute law supervision on telecommunication industry. The second chapter deals with the operational mechanism of the telecommunication supervisory system. The author analyses, discusses on the execution and supervision of the system and furthermore explores the drawbacks of our current telecommunication supervisory system. In the third chapter, through comparing the law foundation, supervision institutes and supervision contents between America and Britain, the author makes comparative study on these two country's supervising system and draws out some inspiration. The fourth chapter dealing with the framing and construction of the telecommunication system in the future suggests improving the legal system of the telecommunication supervision, puts forward to innovate our supervision system. Finally, the author summarizes the main points of this thesis and believes that these analyses and argumentations can be helpful to our future law supervision and management of our telecommunication system and to the development of this industry.
