Antitrust Law Enforcement Agency In Our Country

The State Department has passed "Antitrust Law(Draft)" in June 2006, and submits to the Standing Committee of the National People's Congress. "The antitrust committee" and "the antitrust law enforcement agency" are established in the draft. Many scholars in China have expressed the different view to the draft. The author thought, antitrust law enforcement agency in our country should be established on two principles. First, antitrust law enforcement agency will be suitable for our nation's reality. Second, we must learn advanced experience from various countries especially the western countries. Therefore, we research present antitrust law agency with emphasis, and make the systematic analysis to the overseas antitrust law enforcement agencies, especially its the function. In conclusion, China should learn from the other countries and make full consideration of our country's present situation, following the principle of "the independence and authority" and "legally establishment". We must establish an independent, authoritative, specialized enforcement agency with the power of administration, jurisdiction and legislation.
