Study On The Legal Issue Of Reproduction In Cyberspace

Simulation technology makes copyright get along with reproduction very well and it can cover all the reproduction problems. However, with the application of digital technology and the spread of network, numerous works can be reproduced randomly. So copyright can't restrain reproduction in network environment. The clash between the characteristics of network environment and the essentials of conventional copyright system has brought strong impact on copyright, especially on reproduction right which is the most basic and important right. The clash is not only technology problems,social problems, but also a big shock in intellectual property area. When sharing the knowledge banquet, we must pay more attention to the problems resulted from reproduction in cyberspace, for we are becoming increasingly dependant on cyberspace resources.The object of the paper is reproduction right. As we all know, reproduction right isn't a new right of copyright, but is endowed with some new significance in cyberspace. Studying on the reproduction right in cyberspace, we should inevitably respond to the define of reproduction range,temporary reproduction,fair use and the limitations of reproduction right, etc, in order to seek balance in this area. These questions are also the focus of this paper.The structures of this paper are as follows:The whole passage is divided into four chapters except the introduction and conclusion. Chapter 1 is the outline of reproduction right. Through researching basic theories of reproduction right and its history, it explains the particularities of reproduction and reproduction right in cyberspace. Chapter 2 raises four copyright problems based on reproduction in cyberspace and the argument of these questions in academic circles. Chapter 3 devotes a great deal of space to introduce relevant legislation and experience abroad and the inspiration to our legislation. Chapter 4 puts forward on some ideas for perfection based on another analysis of relevant reproduction legislation in China's cyberspace and some thoughts of relevant problems outside legislation.
