Study On Human Rights Liability Tracing Of Transnational Corporations

With the development of transnational corporations(TNCs), more and more cases raised involving their infringements of the international human rights law, especially in the field of environment and labor protection. The liability of TNCs in human rights protection is the hot issue now. More and more international lawyers begin to makes research on this topic. On the basis of introduction and deep analysis of the background, drive, content, mode of regulation and course of redress, the author tries to put forward some detailed and feasible suggestion to Chinese government.The thesis consists of four parts:Part one gives brief introduction of human rights liability of TNCs. Firstly, the author analyses the reason and drive why TNCs should take human rights liability. And then the author makes analysis on the content and standard of human rights liability of TNCs.Part two introduces and analyses the present regulatory mode of human rights liability of TNCs. First, the author gives introduction of exterior regulatory mode in international and national level, and makes analysis of the effectiveness of the exterior regulatory mode as well. Then the author introduces the interior regulatory mode of human rights liability of TNCs and makes deep analysis on its effectiveness.Part three analyses the course of redress for the victims of TNCs's human rights abuse. The author first analyzes the defendant which should be brought into the suit and which forum should bring to. Then the author makes deep analysis on cases occurred in USA, UK and Canada.Part four analysis the current legislation and practice of Human Rights Liability of TNCs inChina and put forward some legislation, judicial and practical suggestion to both the government of China. Firstly, the author analyze current situation of TNCs's human rights liability in China. Then makes analysis the problem existing in human rights liability of TNCs in China and put forward some legislation, judicial and practical suggestion to the government of China.
