Legal problems of human rights violations caused by transnational corporations due to labor,environmental protection,products safety and other issues are not uncommon.On the one hand,multinational companies have contributed a lot to the development of the global economy.On the other hand,there are also a large number of human rights violations by multinational companies.The international community represented by the United Nations attaches great importance to the handling of transnational corporations and human rights issues,mainly reflected in the formulation of a large number of "soft law" rules to restrain the relevant business activities and illegal activities of multinational companies.For example,as early as the 1970s,the International Labor Organization issued the "Tripartite Declaration of Principles Concerning Multinational Enterprises and Social Policy" concerning multinational companies and human rights protection.In 2014,the United Nations Human Rights Council adopted Resolution 26/9 to establish an open-ended intergovernmental working group on the negotiation of legal instruments on multinational corporations and human rights issues.In 2018,the Working Group published the Legally Binding Instrument to Regulate,in International Human Rights Law,the Activities of Transnational Corporations and Other Business Enterprises(Zero Draft),the publication of this legal instrument marked the substantial progress in negotiations between transnational corporations and human rights issues.Due to the slow progress in the negotiation of legal instruments,the host country and home country regulation of multinational companies,international "soft law" regulation,and corporate production code regulation all have regulatory difficulties.Facing the real urgency of regulating multinational corporations' human rights violations,enhancing the role of multinational corporations' home country regulations,accelerating the international legislative process,and giving play to the multilateral role of non-governmental organizations is an important approach to dealing with multinational corporations and human rights issues.
