Research On The "Labor Dispute Processing Law" Of Nanjing National Government From 1927 To 1937

Labor-capital relations are significant to the enterprise and country. The " Labor dispute processing Law" which can protect the laborers benefits, dealing with labor dispute, is playing the vital role in the stable production order. Soon after the foundation of Nanjing National Government, in 1928, the Kuomintang published " Labor dispute processing law ", resulting from on one hand, an increasing attention given by the International Labour Union, in terms of China's labour problem and on the other hand, the governs aim to consolidate its ruling order and develop its capitalist economy. The law, comprehensive and complete, occupies a significant position in the history of legislation of modern China. It, therefore, is of much meaningfulness to have an investigation of the law's implementation as well as the subsequent influence upon the then society so that we are able to draw what today's socialist market economy can takes as reference.This article is made up of five parts:Introduction is an illustration of the basis upon which the subject is settled, the meaning and literature review on this subject.Chapter one: analyses the domestic and international background behind the " Labor dispute processing law ", it also expends the legal basis , the guiding and principles, and the implementation of the " Labor dispute processing law" by the Nanjing national government.Chapter two: examines the legislations and clauses of the " Labor dispute processing law ", narrates two revisions of the " Labor dispute processing Law", and has carried on the detailed comparison among them.Chapter three: this chapter is devoted to the objective observation of the implementation of the " Labor dispute processing law" , effectiveness, and the factory's conditioning its implementation.In conclusion, a brief summary is given, in addition to an overall evaluation of the " Labor dispute processing Law" by the Nanjing National Government. It is pointed out that the present study is enlightening and inspiring when it comes to the settling of the labour disputes under the socialist market economy, and the building of our legal system and law enforcement system.
